The main task of the Mergers & Acquisitions Group is to assess if proposed mergers or acquisitions will, or are likely to, result in a substantial lessening of competition. The Group may assess matters that are referred to them by merger parties or that are brought to the ACCC's attention by other parties, for example through press reports or complaints from third parties.

Merger Authorisation Guidelines

Following changes to the Act which came into effect on 6 November 2017, the ACCC was given power to authorise proposed acquisitions. The ACCC Merger authorisation guidelines help businesses and their advisers understand the provisions relating to merger authorisations, and how the ACCC proposes to assess applications for merger authorisation under the new test.
